Regulations of the Raskal's Store www.appenzeller.com.pl, Monika Grzesiak,

These regulations (hereinafter referred to as the "Regulations") define the rules for access and use of the sklep-appenzeller.com.pl website (hereinafter referred to as the "Website"). Purchasing Goods on the Website is tantamount to accepting the terms of the Regulations.

 

I. General provisions

1. The website is run by an entrepreneur operating under the name Monika Grzesiak
based in Tuchola ul. Nad Kiczej 26, NIP 6661872817, REGON 341281029 (hereinafter referred to as the "Seller"). Contact details: e-mail:grzesiakmonika@gmail.com, tel.: +48662077833 - cost of the fee, according to operators' rates.

2. These Regulations define the rules for using the Website for the purpose of concluding contracts
and execution of sales contracts for Goods offered on the Website.

3. The administrator of Users' personal data is the Seller.

Definitions.

Website – online website sklep-appenzeller.com.pl, enabling the conclusion and performance of sales contracts for Goods offered on the Website.

Regulations - these Regulations are the regulations referred to in Art. 8 section 1 of the Act of July 18, 2002 on the provision of electronic services, made available to Users via appenzeller.com.pl

Prices – prices of Goods available on the Website.

User – an adult natural person, a legal person or an organizational unit without legal personality, with legal capacity, who uses the Website to purchase Goods.

Registration - registration on the Website, which involves providing in the registration form: name, surname, e-mail address (e-mail address), telephone number and the exact address of residence of the natural person registering or the registered office of the entrepreneur in the case of acting on behalf of the entrepreneur.

User Account – a set of resources and authorizations in the Website's computer system available to Users. The account has a unique name (e-mail address) and is password protected. The authorization process on the Website requires access to the User Account by providing a username and password.

Goods – within the meaning of the Regulations, are all products offered via the Website.

Supplier – an entity with which the Seller cooperates on the Website
for the purpose of delivery of the Goods.

 

II. Rules for using the Website

The website fulfills User's orders in the Republic of Poland and abroad.

Ordering Goods via the Website does not require Registration.

The User may register on the Website by completing the registration form. Successful Registration will be confirmed by an automatically generated response message sent to the e-mail address provided during Registration.

Ordering Goods via the Website requires acceptance of the terms of the Regulations by checking the "I have read" box
with the Regulations and accept its provisions.

By ordering Goods on the Website, the User undertakes to comply with the provisions of these Regulations.

The information contained on the Website does not constitute an offer
within the meaning of the provisions of the Civil Code.

The prices of Goods posted on the Website are gross Prices; are given in Polish zloty and include tax on goods and services (VAT). The prices of goods do not include delivery costs, which are covered by the User. Delivery costs are indicated when placing the order and added to the Price of the Goods at the end of the order. Before the User places a binding order, he will be informed about the total Price of the Goods.

On the Website, information about their availability is provided next to individual Goods.

The Seller reserves the right to change the Goods and their Prices available on the Website. This does not apply to Goods and their Prices in relation to which the order has been confirmed by the Seller.

Orders can be placed via the Website 24 hours a day. When ordering the Goods, the User selects the color of the Goods, where possible
in the field assigned to a given Good, and selects the "Add to cart" option. The contents of the "basket" can be modified using the "View basket" option until the order is placed, as mentioned

in paragraph 10 below.

The order is considered placed and not subject to further modifications when the User selects the "I confirm the order and pay" option. Correct placing of the order will be confirmed by a reply message sent to the e-mail address provided during Registration and will include, among others: name of the product, quantity purchased, total Purchase Price for the Goods together with applicable taxes, method of payment and method of performance by the Seller.

Placing an order by the User means submitting an offer to purchase a specific Good for the Price indicated in the order (including delivery costs). The offer is binding on the User if the Seller confirms receipt of the order. Price and other e 

Order elements are binding for the User and the Seller from the moment the Seller confirms the order.

Lack of confirmation of receipt of the order or its acceptance within 2 days of placing it,
as referred to in section 11 above is tantamount to cancellation of the order by the Seller. Canceling an order does not give rise to any rights to compensation.

1In the cases referred to in point III section 2, the Seller will cancel the order unpaid by the User within 14 days from the date of order confirmation,
referred to in section 11 above.

 

III. Order fulfillment and delivery conditions

The ordered Goods are shipped within 7 business days from the date of order confirmation (if the payment on delivery option is selected) or from the moment the Price of the Goods purchased by the User is credited to the Seller's bank account (prepayment option). The goods are sent via Poczta Polska, InPost or the DPD courier company

When placing an order, the User selects the form of payment for the Goods and the method of delivery.

Delivery costs are indicated in the order basket before placing the order.

Payment of the Price for the Goods, if the User chooses the prepaid option, is made via the Przelewy24 website.

When placing an order and selecting a postal shipment, the User authorizes the Seller to ship the Goods on behalf of and for the User. Thanks to this authorization, the Seller can reduce shipping costs by not adding 23% VAT. Actual postal costs do not constitute the Seller's income and are not subject to PD and VAT.

The Seller is not responsible for longer delivery times of the Goods than those declared by entities providing delivery services.

 

IV. Complaint

Complaints regarding the functioning of the Website should be submitted by the User
when irregularities are detected in the provision of electronic services,
in writing to the following address:grzesiakmonika@gmail.com

Any complaints regarding defects in the sent Goods, together with a detailed description of the grounds for the complaint, should be submitted in writing to the following address:grzesiakmonika@gmail.com.

Complaints submitted by Users will be considered by the Seller, who undertakes to thoroughly investigate the circumstances of the irregularities.

Complaints will be considered by the Seller within 7 days from the date of their submission.

If the User finds damage to the package, he or she should inspect the contents in the presence of the courier. If damage to the Goods is detected, the Supplier is obliged to prepare an appropriate report together with the User in order for the Supplier to pay compensation to the User for the losses incurred.​

VI. User's account

After Registration on the Website, a User Account is created. After logging in, the User gains access to the archive of purchases made on the Website. Through the Account, the User may also change the data provided during Registration.

The User Account also enables ongoing tracking of the status of the order placed by the User, assigning one to the placed order
of the following statuses:

a) Waiting for payment confirmation from Przelewy24 - means that the Seller has not yet received payment of the Price for the Goods;

b) Payment accepted - means that the Seller has received payment of the Price for the Goods;

c) Order accepted - means that the order has been placed correctly, paid or the "cash on delivery" payment method has been selected
and accepted by the Seller;

d) Shipped - means that the Goods have been completed and sent to the delivery address indicated by the User;

e) Canceled - means that the order was canceled at the request of the User or by the Seller for the reasons referred to in point II section. 13;

f) Payment error - means that an error occurred while making the payment and the Seller did not receive the payment of the Price for the Goods;

g) Ready for collection - means that in the case of personal collection,
referred to in point III section 5a, the Goods are ready for collection at the Seller's premises;

h) Delivered - means that the Goods ordered for personal collection have been delivered to the User;

i) Return - means that the User, in accordance with point VI section 1, decided to withdraw from the Agreement

 

VII. Responsibility

The Seller is not responsible for excessively overloaded Internet connection of the User or other inter-operator connections.

The Seller is not responsible for any disruptions in the functioning of the Website caused by unauthorized interference by Users, in any way independent of the Seller.

The Seller is not responsible for the consequences of actions resulting
from providing the login and password to access the Website to third parties.

If it is necessary to make changes and improvements to the system, perform maintenance work or equipment failure, the Seller reserves the right to a temporary break in the operation of the Website
